Recreational use is not legal in South Dakota.

Medical Cannabis in South Dakota

Medical cannabis is legal in South Dakota since 2020. Licensed dispensaries are operating.

Patients enrolled in the South Dakota program must meet state-specified qualifying conditions and obtain a registry card from the South Dakota Department of Health. Program rules cover possession amounts, caregiver designations, and reciprocity with out-of-state cards.

Home Cultivation

Home cultivation is permitted in South Dakota. Plant limit: 3 per adult. Medical patients only, limited circumstances

Hemp-Derived CBD

CBD is legal in South Dakota. Hemp-derived CBD with THC at or below 0.3% is allowed.
